  14. Tuesday, June 25 is "Call Congress Day" to oppose passage of
  15. S.984 and H.R.1946, the Parental Rights and Responsibilities Act
  16. (PRRA). In spite of its title, the PRRA is dangerous legislation
  17. which would be extremely destructive to public education, open
  18. schools and teachers to the threat of lawsuits, and jeopardize
  19. health and welfare programs for children.
  20.  
  21. Background. H.R.1946 was introduced in the House by Congressman
  22. Steve Largent (R-OK) and its companion bill, S.984, was
  23. introduced in the Senate by Senator Charles Grassley (R-IA). On
  24. April 17, 1996, S.984 was approved 4-3 by a Senate Judiciary
  25. subcommittee.

  27. Summary. The PRRA states that no federal, state or local
  28. government "shall interfere with or usurp the right of a parent
  29. to direct the upbringing of the child." Parental rights include
  30. directing or providing for a child's education, making health
  31. care decisions for a child, providing discipline for a child, and
  32. directing or providing for the child's religious teaching. The
  33. bills would allow any parent to bring a lawsuit in federal or
  34. state court challenging any policy, program or activity. The
  35. suits would be examined under the highest judicial standard --
  36. i.e., the government, would have to demonstrate that the program,
  37. policy or activity services a compelling government interest and
  38. is the narrowest and least restrictive means of accomplishing the
  39. interest.

  41. Action Needed -- Call In Day. On June 25, the Christian Coalition
  42. will be visiting offices on Capitol Hill, lobbying in support of
  43. the PRRA. In order to counteract the barrage of support, we urge
  44. you to call your representative and senators on June 25 to oppose
  45. the PRRA. You can use the AFT toll-free number (1-800-238-1727)
  46. to reach the U.S. Capitol Switchboard. If you can't call on June
  47. 25, calls (or letters) at any time would be useful. Some talking
  48. points on the PRRA follow.

  50. Talking Points on the Parental Rights and Responsibilities Act
  51. (PRRA):
  52.  
  53. --Although the "Parental Rights and Responsibilities Act " sounds
  54. innocuous, this legislation would place the health, welfare,
  55. education and safety of our nation's children at risk. The
  56. legislation would allow any parent to challenge in court
  57. virtually any decision of health and child welfare agencies,
  58. libraries, and public schools. The proposal would undermine these
  59. public institutions, jeopardize the access of children to health
  60. care, thwart child labor laws, and threaten efforts to protect
  61. children from abuse.
  62.  
  63. --Child welfare agencies, hospitals, community health clinics,
  64. schools and other public institutions would be forced to divert
  65. scarce resources needed to provide services to children and use
  66. these funds to defend against litigation.
  67.  
  68. --The PRRA makes parents the only judge of what is appropriate
  69. for their children in education and empowers them to demand it
  70. from schools. The law invites parents to sue schools -- and
  71. teachers and school employees -- over any element of the school's
  72. curriculum, programs or activities that they may disagree with.
  73. Any course, any book assigned, any test given, any school rule
  74. enforced could be challenged by parents as interfering with the
  75. parental right to direct the education of the child.
  76.  
  77. --Under the PRRA, schools could be forced to design an
  78. individualized curriculum for any or every student. Parents could
  79. demand that their child be taught creationism, for example, or
  80. any other special alternative that reflects the values of the
  81. parents. Parents could also simply insist that their child be
  82. permitted to opt out of any required course they don't like --
  83. English, social studies, biology, you name it.
  84.  
  85. --Under the PRRA, parents could challenge any school district
  86. policies or rules with which they disagree -- no pass/no play,
  87. student hair and dress codes, teacher grading decisions, or basic
  88. health care in schools, such as hearing and vision testing, and
  89. sports physicals.
  90.  
  91. --The legislation is an unfunded mandate of the worst kind. The
  92. costs to schools and other public agencies of defending lawsuits
  93. and developing individualized curricula or services could run to
  94. billions of dollars a year.
  95.  
  96. --Individual educators would also be at financial risk, since
  97. they could be taken to court and found personally liable for
  98. anything they teach which is contrary to the values of individual
  99. parents. Educators could face financial consequences for teaching
  100. evolution, or even Romeo and Juliet, which deals, with suicide
  101. and disobedience to parents, or Macbeth (witchcraft). This will
  102. certainly have a chilling effect on education.

  104. --Proponents of private school vouchers intend to use the PRRA to
  105. promote public funding of vouchers. They believe enactment of the
  106. PRRA would make it easier to win in court by arguing that
  107. vouchers are the best way to allow parents to "direct the
  108. education" of their children.
